Welcome to TicketScanner. These Terms of Use ("Terms") govern your access to and use of the TicketScanner website and related features (collectively, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.
1. Description of the Platform
TicketScanner operates as a ticket price comparison and data aggregation website. The Platform enables users to compare ticket prices and identify the cheapest tickets available across various ticket marketplaces.
TicketScanner is not a ticket seller, does not issue tickets, and does not process payments for ticket transactions. Unless expressly stated otherwise, TicketScanner is not affiliated with any venue, artist, team, promoter, or official box office.
2. No Ticket Sales or Transactions
TicketScanner does not sell, resell, distribute, or guarantee tickets. When you click on a listing, you may be redirected to a third-party website. Any purchase or transaction is solely between you and the third-party seller or marketplace.
TicketScanner is not responsible for pricing accuracy, ticket availability, order fulfillment, refunds, cancellations, disputes, delivery failures, or any issues arising from transactions conducted on third-party websites.
3. User Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform.
4. Permitted Use
You agree to use the Platform only for lawful purposes.
You may not:
- Use the Platform in violation of applicable laws
- Attempt to interfere with the security, integrity, or performance of the Platform
- Use bots, scraping tools, automated scripts, or similar methods to access or extract data in a manner that imposes excessive load
- Copy, reproduce, republish, distribute, or commercially exploit Platform content without authorization
- Attempt to build a competing service using Platform data
5. Intellectual Property
All content, software, layout, branding, data presentation, graphics, and design elements on the Platform are owned by or licensed to TicketScanner and are protected by applicable intellectual property laws.
You may not use the TicketScanner name, logo, trademarks, or branding without prior written consent.
6. Data and Pricing Disclaimer
TicketScanner aggregates publicly available ticket listing information and marketplace-supplied data. While we strive to present accurate and timely information, we do not guarantee the completeness, reliability, or real-time accuracy of listings.
Ticket prices and availability may change without notice. TicketScanner does not guarantee that any listed price represents the lowest available price at the time of purchase.
7. Third-Party Links and Services
The Platform contains links to third-party websites. TicketScanner does not control and is not responsible for the content, policies, security, or practices of third-party sites.
Your interactions with third-party services are governed solely by their terms and policies.
8. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, TicketScanner disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
TicketScanner does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, TicketScanner shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Platform.
In no event shall TicketScanner's total liability exceed one hundred U.S. dollars (USD $100).
10. Indemnification
You agree to indemnify and hold harmless TicketScanner and its affiliates from any claims, damages, liabilities, losses, or expenses arising from:
- Your misuse of the Platform
- Your violation of these Terms
- Your violation of applicable law
- Your interactions with third-party sellers or marketplaces
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
12. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights.
a. Informal Resolution
If you have a dispute relating to these Terms or the Platform, you agree to first attempt to resolve it informally by contacting TicketScanner.
b. Agreement to Arbitrate
Except as provided below, any dispute arising out of or relating to these Terms or the Platform shall be resolved through final and binding arbitration, rather than in court.
This arbitration agreement applies broadly to all claims, whether based on contract, tort, statute, fraud, misrepresentation, or any other legal theory.
c. Exceptions
Either party may bring an individual claim in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized interference with the Platform.
d. Arbitration Procedure
Arbitration shall be administered by the American Arbitration Association (AAA) under its applicable rules. A single arbitrator will preside. Arbitration may take place in San Francisco County, California, or remotely as permitted by AAA rules.
e. Fees
Arbitration fees shall be governed by AAA rules and applicable law.
13. Class Action Waiver
You and TicketScanner agree that disputes shall be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding.
If a court determines the class action waiver is unenforceable for a particular claim, that claim shall proceed in court while all remaining claims remain subject to arbitration.
14. Opt-Out of Arbitration
You may opt out of the arbitration agreement by sending written notice within thirty (30) days of first accepting these Terms.
Your notice must include your name and a clear statement that you wish to opt out of arbitration.

15. Venue
To the extent any dispute is permitted in court, such dispute shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
16. Modifications
TicketScanner reserves the right to modify these Terms at any time. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
17. Termination
TicketScanner may suspend or terminate access to the Platform at any time, without notice, if you violate these Terms or misuse the Platform.
18. Entire Agreement
These Terms constitute the entire agreement between you and TicketScanner regarding the use of the Platform and supersede all prior agreements.
